Title

Analysis
This resolution will remove a deed restriction imposed by the City of Milwaukee that prohibits division of the property and construction of any principal buildings on the property.
Body
Whereas, Pursuant to Common Council File No. 971891, adopted April 7, 1998, the City of Milwaukee conveyed to Norman G. Landry by a Quit Claim deed dated November 19, 1998, a tax-deed vacant lot at 2526 North Palmer Street that adjoined his property at 2528-30 North Palmer Street; and
 
Whereas, The deed of conveyance contained restrictions that the land conveyed therein "shall be used as open space and no principal buildings may be erected thereon, to join the lot with the buyer's adjoining property so as to create a single parcel to be used as a unit, and that the combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee"; and
 
Whereas, Mr. Landry has requested removal of the deed restriction to allow him to sell a portion of the former tax-deed vacant lot to the other adjoining owner for garage construction; and
 
Whereas, Removal of the deed restriction is required for the aforementioned sale to occur; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute the necessary legal documents to remove the restrictions contained in the deed dated November 19, 1998, to allow for the sale of a portion of the property to the adjoining owner.
