Title

Resolution relating to the issuance of parking citations by first-class mail.

Analysis

This resolution directs the Department of Public works to initiate a one-year, city-wide pilot program to issue night parking citations by first-class mail for the violations of no permit and wrong side parking.  The pilot program will begin January 1, 2022. 

 

Whereas, City parking rules and regulations are established by ch. 101 of the Code of Ordinances; and

 

Whereas, A violation of these parking regulations is a municipal ordinance violation; and

 

Whereas, Section 800.01, Wis. Stats., governing the commencement of actions in municipal court, provides that a citation may be sent to a violator by first-class mail; and

 

Whereas, The information generally provided in a parking citation is likely sufficient to satisfy the statute’s requirements; and

 

Whereas, In order to further satisfy the considerations of 800.02,Wis. Stats., parking citations issued by first-class mail may include information identifying the violator; and

 

Whereas, The Department of Public Works is prepared to begin a pilot program for the issuance of night parking citations by first-class mail on January 1, 2022; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Department of Public Works is directed to implement a one-year, city-wide pilot program which will issue night parking citations by first-class mail for the violations of no-permit and wrong side parking; and, be it

 

Further Resolved that the pilot program shall begin January 1, 2022; and, be it

 

Further Resolved, That the Department of Public Works shall provide to the Common Council an interim report midway through the pilot program and a final report at the conclusion of the pilot program.
