Title
Substitute resolution declaring a vacant, City-owned lot located at 1827 North Marshall Street surplus and accepting Offers to Purchase from both adjoining owners for parcel expansion purposes, in the 3rd Aldermanic District.
Analysis
This substitute resolution will result in the sale of a City-owned lot for use by the adjoining owners.
Body
Whereas, Patricia Wyzbinski and Scott E. Gelzer, with their property located at 1825 North Marshall Street, have offered $5,000 to purchase part of the City-owned vacant lot adjoining their property which will allow them sufficient room for a side drive along with proper landscaping; and

Whereas, Five and Ten Tap LLC, with its property located at 1850-60 North Water Street, has offered $7,145 to purchase the remaining part of the City-owned vacant lot adjoining its property to screen and landscape it; and

Whereas, The Department of City Development recommends acceptance of said offers contingent upon site plan approvals prior to closing; and

Whereas, Should either adjoining owner not perform according to plan approvals, the full parcel may be sold to the compliant adjoining owner for the full purchase price; and

Whereas, Said lot is to be sold in an “as is” condition without representations or warranties including but not limited to soil quality and subsurface condition; and

Whereas, The City Plan Commission has determined that there is no municipal need for said lot; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the vacant, City-owned lot located at 1827 North Marshall Street is declared surplus, that the Offers to Purchase from both adjoining owners are accepted and that the proper City officials are authorized and directed to perform such acts as necessary to carry out the intent of this resolution with the proceeds from the sales, less a 20 percent disposition cost reimb...
