Currently, the code provides that, as a condition for granting a special privilege for an obstruction or excavation beyond the street line, the grantee shall file with the city clerk a surety bond in an amount determined by the common council (but not to exceed $10,000), subject to the approval of the city attorney. This ordinance provides that, in lieu of the surety bond, the grantee may submit a cash deposit in the same amount.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 245-12-3-b of the code is amended to read:
245-12. Special Privileges.
3. PROVISIONS.
b. File with the city clerk >>a cash deposit or<< a bond of a surety company duly incorporated in the state of Wisconsin or duly licensed to do business in this state, in such sum as the common council may require but not exceeding $10,000, such >>deposit or<< bond to be approved by the city attorney. Individual sureties shall not be deemed in compliance with this section. The applicant shall also file with the city clerk a certificate of insurance indicating applicant holds a public liability policy in the sum of at least $25,000 covering bodily injury to any one person, and $50,000 covering bodily injury to more than one person in any one accident, and $10,000 covering property damage to any one owner on the area or areas included within the special privilege, and naming the city of Milwaukee as an insured.
