Resolution authorizing permanent easements at 1600 West Edgerton Avenue and at 4927 South 15th Place with the Wisconsin Department of Transportation for the I-94 reconstruction project, in the 13th Aldermanic District.
Analysis
This resolution permits the City of Milwaukee to execute easements to facilitate freeway reconstruction.
Body
Whereas, The Wisconsin Department of Transportation (“WISDOT”) presented the City of Milwaukee (“City”) with an offer to acquire permanent limited easements at the City-owned properties at 1600 West Edgerton Avenue and at 4927 South 15th Place to maintain slopes adjacent to the I-94 right-of-way; and
Whereas, The property at 1600 West Edgerton Avenue is currently used as a tot lot, but the Department of Public Works determined that WISDOT’s easement will not adversely affect the tot lot improvements or current use of the site; and
Whereas, The property at 4927 South 15th Place is adjacent to additional City-owned property and the WISDOT easement will not adversely affect future development; and
Whereas, WISDOT also has presented offers to the City for temporary easements to facilitate the highway reconstruction at five City-owned vacant lots; and
Whereas, The appraisals presented by WISDOT have been reviewed by the City Real Estate staff and the offering values have been determined to be reasonable consideration for the easements; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of the Department of City Development, or designee, is authorized to execute permanent and temporary easements with WISDOT; and, be it
Further Resolved, That the proceeds from the easements, less a 30 percent cost reimbursement to the Redevelopment Authority, shall be deposited in the Reserve For Tax Deficit Fund or the General Fund based on the method of property acquisition.
