Substitute resolution amending the City of Milwaukee’s State Legislative Package to express support for state legislation making illegal tire dumping a misdemeanor crime and providing penalty enhancements.
Analysis
This resolution amends the City of Milwaukee’s State Legislative Package to include support for 2025 Wisconsin Senate Bill 1059, which makes intentionally depositing 4 or more tires on public property or another person's private property a Class A misdemeanor punishable by up to 9 months incarceration and a $10,000 fine, and provides for a penalty enhancer for subsequent acts of illegal dumping.

Whereas, Illegal tire dumping is a significant problem both in Milwaukee and state-wide; and
Whereas, The cost of cleanup for municipalities and innocent property owners can be substantial, often costing thousands of dollars per incident to remove and properly dispose of tires that were illegally dumped on their property; and
Whereas, Under current law, dumping tires is a civil forfeiture offense with penalties up to $1,000 and optional restitution, which does little to discourage the practice; and
Whereas, 2025 Wisconsin Senate Bill 1059 makes intentionally depositing 4 or more tires on pubic property or another person's private property a Class A misdemeanor punishable by up to 9 months incarceration and a $10,000 fine and provides for penalty enhancements for subsequent incidents of illegal dumping; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that Common Council File Number 241415, adopted January 21, 2025, is amended by inserting the following item into the document attached to the file titled “2025-26 State Legislative Package”:
