This resolution authorizes settlement of the lawsuit of Carol Rushman v. City of Milwaukee, in the amount of $22,862.41. _____________________________________________
BODY:
Whereas, The plaintiff, Carol Rushman, has filed a lawsuit against the City of Milwaukee seeking an unspecified amount of damages based upon the claim that her first amendment rights were violated by the enforcement of an ordinance prohibiting fortunetelling; and
Whereas, The court has granted the plaintiff, Carol Rushman, summary judgment on the liability issues relating to her claimed violation of her first amendment right and the only issue remaining for determination is the amount of damages, including attorneys fees, to which the plaintiff is entitled; and
Whereas, The plaintiff has agreed to settle the lawsuit in the amount of $22,862.41; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to settle this lawsuit; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $22,862.41 payable to the order of Carol Rushman and Hall, Patterson & Charne, S.C. in full and final settlement of this lawsuit, upon receipt of a release of claims, approved as to form and execution by the City Attorney, said amount to be charged to the Damages and Claims Fund, Account No. 01-013-8001.
