Title
A substitute charter ordinance relating to duty disability benefits for members of the firemen's annuity and benefit fund.
Analysis
This charter ordinance relieves the employes' retirement system from enforcing the provisions of s. 34-01-50-e-1 requiring each disabled fireman who receives a duty disability benefit to be examined at least once a year.
Body      
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1:   Notwithstanding the provisions of s. 34-01-50-e-1, no fireman who became disabled between April 6, 1975 and October 1, 1977 who is eligible to receive a lifetime duty disability retirement benefit shall be required after the effective date of this charter ordinance June 5, 2001,  to submit to an examination at least once a year by one or more licensed and practicing physician or physicians.  
 
Part 2.       This is a charter ordinance and shall take effect 60 days after its passage and publication, unless within such 60 days a referendum petition is filed as provided in s. 66.0101(5), Wis. Stats., in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.
