Substitute resolution authorizing the proper City Officials to execute an agreement conveying public water mains to TDC Milwaukee, LLC.

Analysis
This resolution authorizes the Commissioner of Public Works to execute an Agreement with TDC Milwaukee, LLC, for the purpose of conveying existing public water mains within the Northridge Shopping Center.

Body
Whereas, Public water mains and facilities currently exist within City of Milwaukee easements within the Northridge Shopping Center; and

Whereas, The developer, TDC Milwaukee, LLC, is in the process of purchasing said property and has requested the City of Milwaukee release public water main easements and the public water main facilities contained therein; and

Whereas, Said public water mains and facilities will no longer serve a public need and will be available and sufficient to serve the private needs of said developer; and

Whereas, The developer will fund all costs related to conveyance of these water facilities including the design and construction of any alteration to remaining public water mains, design and construction of required metering facilities including water meters, easement releases or modifications and other related ancillary items; and

Whereas, Upon said conveyance, the developer will assume private ownership, control, operation, maintenance and water quality of said water main facilities and provide water service in accord with all pertinent State and Local rules and regulations for operating a private water supply to all current and future properties located with the limits of this development and served by this private water main; and
Whereas, The developer shall prepare documentation establishing the appropriate safeguards and controls to ensure water service to all current and future properties within the development, said documentation to be made available to the City for review; now, there...
