Title
Substitute resolution relating to the lease agreement governing a parking garage used by the Marcus Center for the Performing Arts.

Analysis
This resolution waives, for one day, the City's portion of the profits derived from the operation of the City-owned parking garage currently used by the Marcus Center for the Performing Arts. On October 8, 2001, the Marcus Center plans to put on a series of benefit performances, all of the proceeds from which will be sent to the victims of the September 11, 2001, terrorist attacks on the United States.

Body
Whereas, On January 1, 1969, by adopting Council File Number 67-4039-g, the Milwaukee Common Council authorized the leasing of a parking garage in the block bounded by North Edison Street, East Highland Avenue, North Water Street and East State Street to the Milwaukee County War Memorial Center, Inc.; and

Whereas, That agreement was amended by Common Council File Number 85-398, adopted on June 25, 1985; and

Whereas, In recent years, this garage has been used for parking by the Marcus Center for the Performing Arts and its predecessor the Milwaukee Performing Arts Center; and

Whereas, Under the current agreement, the Marcus Center and the City receive an equal share of the profits from the operation of this parking garage; and

Whereas, On October 8, 2001, the Marcus Center will be presenting a series of performances to benefit the victims of the September 11, 2001, terrorist attacks on the United States; and

Whereas, The Marcus Center and all those scheduled to perform at the benefit intend to send 100% of the proceeds from the event to the "September 11th Fund"; and
Whereas, The Marcus Center has indicated that it would like to send 100% of the money received from parking revenues on that evening to this most worthwhile cause; now, therefore, be it
