Title
Resolution declaring a vacant, tax-deed lot surplus to municipal needs and authorizing its sale to the Housing Authority of the City of Milwaukee for residential construction, in the 15th Aldermanic District.
Analysis
This resolution will result in the sale of a vacant, tax-deed lot for assemblage and residential construction.
Body
Whereas, The Common Council of the City of Milwaukee by File No. 040209, adopted July 7, 2004, authorized the Department of City Development ("DCD") to sell various vacant lots to the Housing Authority of the City of Milwaukee ("HACM") for $1 each for construction of single-family homes for qualified owner-occupants; and

Whereas, An additional vacant lot at 2235 West Lloyd Street is necessary for inclusion in the assemblage of buildable sites to create another construction site; and

Whereas, DCD recommends sale of this lot for $1 to HACM contingent upon final site and building plan approval prior to closing; and

Whereas, A portion of several of said lots was previously sold to adjoining owners for use as green space and the deeds conveying the lots contain restrictions that will not permit assemblage or division of the properties nor new construction; and

Whereas, Removal of any deed restrictions is necessary to build housing on said assemblage of lots; and

Whereas, Said lot is to be sold in an "as is" condition without representations or warranties including but not limited to soil quality and subsurface condition; and

Whereas, The City Plan Commission has determined that there is no municipal need for said lot; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that 2235 West Lloyd Street is declared surplus, that sale to the Housing Authority of the City of Milwaukee for $1 is approved and that the Commissioner of DCD, or designee, is authorized and directed to perform such acts as necess...
