Title
Resolution authorizing the Commissioner of Health to execute agreements to facilitate abatement of lead hazards in residential properties.
Analysis
This resolution authorizes the Health Department to enter into 3 party agreements between the Health Department, the City’s contracted lead abatement company, and the owner of a property. These agreements allow access to the property by the contracted abatement company and assure appropriate preparation and care for the owner or tenant’s personal property.
Body
Whereas, Milwaukee Code of Ordinances Chapter 66-20 through 66-29 provide for inspection of properties to identify lead hazards, including issuance of orders to correct lead hazards and permitting of lead hazard removal projects; and,
Whereas, the city of Milwaukee funds and issues contracts for lead hazard abatement projects in qualified residential properties to abate lead hazards, including through grants from the U.S. Department of Housing & Urban Development; and,
Whereas, agreements between the city, property owner, and lead abatement contractor hired by the city are required to ensure access and security of properties to conduct these abatements; now, therefore be it
Resolved, by the Common Council of the City of Milwaukee, that the Health Commissioner is authorized to execute agreements substantially similar to Exhibit A included with this resolution.
