Title
Substitute resolution authorizing the City Attorney to represent private-party plaintiffs, in their individual capacities, in any action challenging the constitutionality and enforceability of 2013 Wisconsin Act 20, s. 1270, relating to residency requirements, and to indemnify them from any liability, including costs or fees, resulting therefrom.
 
Analysis
This resolution authorizes the City Attorney to represent, as the City Attorney deems appropriate, private-party plaintiffs, in their individual capacities, in any action challenging the constitutionality and enforceability of 2013 Wisconsin Act 20, s. 1270, relating to residency requirements.  This resolution also authorizes the City to indemnify private-party plaintiffs from any liability resulting from their participation in this litigation.
 
Body
Whereas, On July 2, 2013, the Common Council adopted Common Council File Number 130382, directing the City Attorney to bring a lawsuit challenging the constitutionality and enforceability of 2013 Wisconsin Act 20, s. 1270, relating to residency requirements; and
 
Whereas, One or more private-party plaintiffs may wish to join the City of Milwaukee in this litigation; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the City Attorney is authorized to represent, as the City Attorney deems appropriate, private-party plaintiffs, in their individual capacities, in any action challenging the constitutionality and enforceability of 2013 Wisconsin Act 20, s. 1270, relating to residency requirements, and that the City indemnify them from any liability, including costs or fees, resulting therefrom.
 
Further Resolved, That such legal representation and indemnification is in the City's best interests and serves a public purpose.
