Title:
Resolution authorizing the Milwaukee Police Department to accept Federally Forfeited Tangible Property or cash when the Police Department participated directly in any of the acts, which led to the seizure, or forfeiture of such property related to the Milwaukee Metropolitan Drug Enforcement Group. (Police Department)

Analysis:
This resolution provides authorization to accept tangible property or cash from the Federal Government when the Police Department participates directly in the seizure or forfeiting of such property.

Body:
Whereas, The U.S. Attorney General Guidelines on Seized and Forfeited Property were approved on May 24, 1985 and published in the Federal Register on June 7, 1985; and

Whereas, These guidelines provide for equitable transfer of forfeited property upon request of the local law enforcement agency pursuant to 21 U.S.C. 8819(c) if the local law enforcement agency participated directly in any of the acts which led to the seizure or forfeiture; and

Whereas, These guidelines further provide that property will be transferred only in cases where the tangible property or cash will be credited to the budget of the local law enforcement agency resulting in an increase of law enforcement resources; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Milwaukee Police Department is authorized to make application for transfer of Metropolitan Drug Enforcement Federally Forfeited Property, which was seized or forfeited as a result of their participation; and, be it

Further Resolved, That the Comptroller of the City of Milwaukee is hereby authorized and directed to establish an account to receive such money that may be transferred by the Federal Government; and, be it

Further Resolved, That the Comptroller of the City of Milwaukee is hereby authorized to transfer interest earned on the Asset Forfeiture Funds to the account ...
