Analysis
This resolution authorizes acceptance of Underground Conduit Easement UG-38B in the area of River Houses Condominium Association, Ltd., located north of 1027 North Edison Street.
Body
Whereas, The City of Milwaukee (“City”) vacated a portion of East Highland Avenue prior to its conveyance of real property further identified on The River Houses Condominium Declaration recorded August 23, 1984 as Document No. 5744695 to River Houses, Inc. (“River Houses Property”); and
Whereas, At the time of vacation, the City did not record an easement document for its underground conduit package because whenever any public highway or public ground acquired or held for public purposes has been vacated, all easements and rights incidental to the easements that belong to the City that relate to any underground structures, improvements or services and all rights of entrance, maintenance, construction and repair of the structures, improvements or services continue; and
Whereas, The City would now like to record such easement for underground conduit facilities located on River Houses Property; and
Whereas, River Houses is willing to grant Underground Conduit Easement UG-38B to the City giving the City permission to enter the property and to construct, operate, maintain, inspect and repair underground conduit facilities within the easement area on terms and conditions negotiated by the City, as reflected in the easement document, a copy of which is attached to this Common Council File; now, therefore, be it
