Analysis
This resolution authorizes and directs the proper city officers to execute the sewer easement releases SER-695, SER-696 and SER-2306, located in the block bounded by North 35th Street, North 36th Street, West Vliet Street and West McKinley Avenue.
Body
Whereas, On October 1 and 12, 1942 and June 22, 1981, the City of Milwaukee was granted sewer easements, located in the block bounded by North 35th Street, North 36th Street, West Vliet Street and West McKinley Avenue, having Tax Key Numbers 366-0908-000-5 and 366-1402-100-9, by Henry W. Marx, Elizabeth D. Marx and Harley-Davidson Motor Company, Cora Walsh Swallow, Nellie Walsh Heffinger and Henry C. Oberly; Burger King, Inc.; and
Whereas, The City of Milwaukee has no existing or planned sewer facilities in the said easements and there is no need to keep the easements; and
Whereas, The Milwaukee Habitat for Humanity requested permission to build over the easements; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper city officers are hereby authorized and directed to execute the Sewer Easement Releases SER-695, SER-696 and SER-2306, a copy of which is attached to Common Council File Number 030150 and incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That after said sewer easement releases have been executed by the proper city officers, they shall be forwarded to the office of the City Attorney for approval as to form and execution and then to the Department of Public Works for recording and proper distribution.
