Resolution amending the disposition of the surplus, vacant, tax-deed lot located at 3501-15 West Burleigh Street, in the 10th Aldermanic District. (DCD)
Analysis
This resolution will result in the sale of a vacant, tax-deed lot.
Body
Whereas, The Common Council of the City of Milwaukee, in File Nos. 001732 and 020760, authorized the Department of City Development (“DCD”) to accept Offers to Purchase the vacant, tax-deed lot at 3501-15 West Burleigh Street for commercial development, and those Offers expired after proposed projects were deemed infeasible; and

Whereas, The North Avenue Community Development Corporation (“NACDC”) has submitted an Offer to Purchase the property, in the amount of $13,500, to build a multi-tenant commercial building; and

Whereas, DCD recommends acceptance of said Offer with closing contingent upon the following terms and all other conditions contained in the Offer to Purchase, a copy of which is attached to this Common Council File:

1. NACDC must submit acceptable plans within 90 days of Offer acceptance. In addition to that required by the building and zoning code, the site and building plans must be acceptable to DCD, i.e., conform with neighborhood context in all respects.

2. NACDC must deliver to DCD evidence of a firm financial commitment to complete the project as proposed.

3. NACDC must complete construction within 9 months from the date of closing; and

Whereas, Said lot is being sold in an “as is” condition without representations or warranties including but not limited to soil quality and subsurface condition; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that said Offer to Purchase is accepted and that the proper City officials are authorized and directed to perform such acts as necessary to carry out the intent of this resolution with the proceeds from the sale, less ...
