This resolution will authorize extension of the CRInc contract in exchange for construction of a permanent railroad spur by CRInc at the Materials Recovery Facility (MRF).

BODY:
Whereas, Contract C930111 dated July 8, 1993, between the City of Milwaukee and U.S.A CRInc is for the Provision of a Materials Recovery Facility (MRF) and Recyclables Receiving, Processing and Marketing Services for the City of Milwaukee; and
 
Whereas, Section 1.3 of Contract C930111 allows for the contractor to operate the MRF from July 1, 1994 through June 30, 2001 with "the City having the option for the extension of this operating agreement on an annual basis thereafter up to an additional period of three years"; and
 
Whereas, Section 1.14 of Contract C930111 allows for the "terms of the contractual relations between the parties may be subject to renegotiation at the request of either the City or the Contractor"; and
 
Whereas, U.S.A CRInc has proven to be a very competent contractor to this point operating the MRF at a high professional standard; and
 
Whereas, U.S.A. CRInc has agreed to provide for the construction of a railroad spur, at the expense of U.S.A. CRInc, which will become a permanent improvement to the MRF site; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is authorized to execute the three year contractual extension at this time.
