Substitute Resolution approving the design of the North 4th, Street pedestrian mall north of West Highland Avenue and south of West Juneau Avenue, in the 4th Aldermanic District.

Analysis
This resolution approves the design of the North 4th Street pedestrian mall as outlined in the plans included in this file.

Body
Whereas, By passage of Ordinance File No. 151444, the Common Council of the City of Milwaukee created Section 113-21 of the Milwaukee Code of Ordinances to establish the North 4th Street pedestrian mall between West Juneau Avenue to West Highland Avenue (the “Pedestrian Mall”), adjacent to the proposed new arena; and

Whereas, By approval of File No. 151748, the Common Council of the City of Milwaukee approved a lease (the “Lease”) between the City and the Wisconsin Center District (the “District”) for the Pedestrian Mall to allow the Pedestrian Mall to be developed into and used as a public plaza; and

Whereas, The Lease with the District permits the District to sublease the Pedestrian Mall to Deer District LLC, or its affiliate, under the same terms and conditions as contained in the Lease; and

Whereas, The Lease requires the design plans for the Pedestrian Mall to (1) be complimentary to and consistent with the design of the adjacent Bucks Arena and Live Block Plaza, (2) be consistent with the Design Guidelines (as defined in the Lease and attached to this File), (3) include appropriate transitions between the Pedestrian Mall and the open public rights-of-way directly north and south of it, (4) allow for the seamless flow of traffic around the Pedestrian Mall and (5) be approved by City’s Common Council before any improvements can be made to the Pedestrian Mall; and

Whereas, Deer District LLC, as the sub-lessee of the Pedestrian Mall, has prepared the designs for the Pedestrian Mall attached to this File and seeks the City’s approval pursuant to the Lease; now, therefo...
