Substitute resolution authorizing the Commissioner of Public Works to issue permits regarding the vacation of portions of the alley bounded by West Garfield Avenue, West North Avenue, North 24th Place, and North 24th Street, in the 7th Aldermanic District.

This resolution authorizes and directs the Commissioner of Public Works to issue the necessary permits for parking lot improvement spanning open alley right-of-way in the block bounded by West Garfield Avenue, West North Avenue, North 24th Place and North 24th Street prior to formal vacation of the alley(s). If the vacation is not completed, the permittee/owner is responsible to restore the alleys to condition satisfactory to the Commissioner of Public Works at no cost to the City.
BODY:
Whereas, Monumental Missionary Baptist Church, 2407 West North Avenue, desires to vacate portions of the alley in the block bounded by West Garfield Avenue, West North Avenue, North 24th Place and North 24th Street; and
Whereas, Vacation of these portions of the alley will facilitate development of adequate parking lots to serve the church which exists on the site; and
Whereas, The alley vacation process is likely to take up to six months to complete; and
Whereas, A delay of that length could jeopardize the project; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized to issue permits which will allow the applicant to perform work in the alley area proposed for vacation in advance of formal vacation; and, be it
Further Resolved, That the Commissioner of Public Works shall not issue such permits until all deposits necessary to fund the City's costs have been made.
