- Analysis

This ordinance provides that no person may keep more than 3 dogs 24 inches or more in height on a residential premises.


BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 78-2-3 of the code is amended to read: 78-2. Keeping of Animals Within City. 3. NUMBER PERMITTED. No person may keep, harbor, shelter or possess at any time more than 3 dogs or cats or any combination thereof which are over the age of 5 months >>or measure 24 inches or more in height at the highest point of the shoulder<< unless the person holds a valid animal fancier permit, kennel permit, pet shop permit or grooming establishment permit. The keeping of more than 3 dogs or cats over the age of 5 months per dwelling unit in a multiple dwelling is declared to be a nuisance. No person in a multiple dwelling shall be granted an animal fancier permit.

Part 2. Section 78-3-2 of the code is repealed and recreated to read:

78-3. Kennels, Horse Stables and Animal Fancier Permits.

2. ANIMAL FANCIER PERMITS. a. The commissioner of health shall issue an animal fancier permit upon the payment of the fee required in s. 60-3.

b. The provisions of this chapter limiting the number of dogs or cats which a person may keep shall not apply

_ to a person holding a valid animal fancier permit on May 2, 1978. Such person shall be permitted to continue to keep indefinitely said dogs or cats over the age of 5 months provided that each of the animals are registered with the health department by breed, color, sex and license tag number, that no nuisance develops as a result of the keeping of these animals and that all other provisions of this chapter are complied with.
