Title
Substitute resolution supporting state legislation relating to distance requirements between certain alcohol beverage licensed establishments and child daycare centers.
Analysis
This resolution expresses support for state legislation to distance establishments granted certain alcohol beverage licenses from child daycare centers.
Body
Whereas, Section 90-14, Milwaukee Code of Ordinances prohibits the granting of Class “A” and Class “B” licenses to establishments selling intoxicating liquor within 300 feet of any church, school or hospital, yet sets no similar 300-feet restriction on such establishments operating near child daycare centers; and
Whereas, These code provisions are based on a 1947 state law imposing the 300-feet requirement in all Wisconsin municipalities for purposes of uniformity; and
Whereas, The number of child daycare centers in Milwaukee has increased noticeably in recent years; and
Whereas, Section 295-311-2-h-2, Milwaukee Code of Ordinances enacted in 2007 partially addresses child daycare location in the vicinity of Class ”A” and Class “B” establishments by prohibiting child daycare centers not located in schools, libraries or religious, community or cultural centers from locating within 300 feet of Class “A” or Class “B” establishments; and
Whereas, Locating an establishment licensed to sell intoxicating liquor within 300 feet of a child daycare center will regularly and frequently expose the children of such child daycare center to behavior, language and activities commonly associated with the purchase and consumption of intoxicating liquor; and
Whereas, The behavior, language and activities commonly associated with the purchase and consumption of intoxicating liquor is widely believed to be detrimental to the physical, mental, emotional and moral development of children; now, therefore, be it
