Title

Resolution approving an easement regarding the Burnham Canal to enable environmental remediation, in the 12th Aldermanic District.

Analysis

This resolution authorizes the City of Milwaukee to enter into an easement agreement to allow Miller Compressing Company to undertake USEPA required environmental remediation of a portion of the Burnham Canal.

Body

Whereas, Miller Compressing Company (“Miller”) requested that the City of Milwaukee (“City”) and other property owners grant to Miller certain easement rights to allow Miller to undertake United States Environmental Protection Agency (“USEPA”) required environmental remediation of a portion of the Burnham Canal; and

 

Whereas, Miller presented to the City a proposed easement agreement, a copy of which is attached to this Common Council File; and

 

Whereas, Per the proposed easement agreement, the City will grant easement rights to Miller in and to possible City property and water interests in and to that part of the Burnham Canal located west of the west boundary of South 11th Street; and

 

Whereas, Remediation work that Miller will undertake, at no cost to the City, includes excavation and remediation, capping the bottom of the canal and long-term monitoring; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that to promote environmental remediation, it directs the proper City officials to sign the proposed easement agreement in the form submitted herewith or in substantially similar form thereto, as determined to be acceptable by the Department of City Development in consultation with the City Attorney’s Office, and to take such further actions as may be necessary to carry out the purpose of this resolution.
