This ordinance repeals the 1972 prohibition against the sale or distribution of household laundry detergent that has a pH greater than 10.9. The ordinance retains the existing prohibition against detergent that contains more than 7 grams of phosphorus per wash load.
BODY:
Whereas, Since 1972, Milwaukee has prohibited the sale of detergents whose pH content exceeded a specified level; and

Whereas, This prohibition was enacted to protect citizens from skin irritation caused by detergents, but pH content alone is not a scientifically valid gauge of irritancy or toxicity; and

Whereas, Many currently-sold consumer products are much more likely to irritate skin, but these products remain available to consumers with appropriate labels and warnings; and

Whereas, Milwaukee may be the only locality in the United States that restricts the pH content of detergents; now, therefore

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 73-30-1-e of the code is repealed.

Part 2. Section 73-30-1-f and g of the code is renumbered 73-3-1-e and f.

Part 3. Section 73-30-3-a of the code is repealed and recreated to read:

73-30. Household Laundry Detergents, Phosphorus Content.

3. LIMITATIONS. a. Concentrations. It shall be unlawful for any person, firm or corporation to sell, offer or expose for sale, give or furnish to another person any household laundry detergent that requires a recommended use level of said detergent that contains more than 7 grams of phosphorus by weight, expressed as elemental phosphorus.

Part 4. Section 73-30-3-c of the code is repealed.
