- ANALYSIS - This resolution authorizes the Commissioner of Public Works to accept a deposit of $75,000 from the developer of the proposed commercial development to be located at the southeast corner of North Humboldt Boulevard and East North Avenue. These funds would be used to undertake preliminary engineering for the public improvements that would be constructed as part of the project.
BODY:
Whereas, American Stores Properties, Inc., owns the approximately 13 acre vacant parcel of land located at the southeast corner of North Humboldt Boulevard and East North Avenue; and

Whereas, American Stores has applied to the City of Milwaukee for a zone change that would permit construction of a commercial development on the site; and

Whereas, Development of the project will require various public improvements, said improvements to be funded via an Out-of-Program Agreement between the developer and the City of Milwaukee; and

Whereas, The City of Milwaukee has not approved the required Out-of-Program Agreement nor has it approved the required rezoning of the development site; and

Whereas, Even though all the necessary approvals have not yet been given, the Developer still wishes the City to proceed with preliminary design of the required public improvements; and

Whereas, The developer is willing to submit a letter to the City acknowledging that additional City approvals are necessary for the project to proceed and that the developer is willing to risk that those funds actually expended on preliminary engi...
