Title

Resolution approving a No Build Easement over a portion of the Summerfest leasehold lands.

Analysis

This Resolution approves a No Build Easement over a City-owned parcel that is part of the Summerfest leasehold in order to assure future compliance with the setback requirements of Section 295-1015-3-c of the Milwaukee Code of Ordinances.

Body

Whereas, Milwaukee World Festival, Inc. owns land at 639 E. Polk Street that it recently improved by renovating an existing building to be used as the new administrative offices for Summerfest; and

 

Whereas, The existing building did not meet current setback requirements under Section 295-1015-3-c of the Milwaukee Code of Ordinances and the renovations to allow for the reuse of the building required Milwaukee World Festival to comply with the existing Code requirements; and

 

Whereas, Because the building, as renovated sits too close to the lot line to meet the necessary setback requirements, a no build easement is required on the property directly adjacent to and east of 639 E. Polk; and

 

Whereas, The parcel directly adjacent to and east of 639 E. Polk is a city-owned parcel that is currently leased to Milwaukee World Festival, Inc.; and

 

Whereas, In order to allow for the reuse, renovation and improvement of the existing building at 639 E. Polk Street, the City is willing to grant a no build easement over its land and Milwaukee World Festival consents to the encumbrance of its leasehold premises with the easement; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the No Build Easement is approved; and, be it

 

Further Resolved, By the Common Council of the City of Milwaukee that the appropriate City officials are authorized to execute the No Build Easement to be recorded on title by Milwaukee World Festival, Inc.
