This resolution authorizes the proper City officials to execute Entry and Testing Agreements on behalf of the City with interested personal communications services companies allowing these companies to perform tests to determine the viability and feasibility of City properties as antenna sites.
BODY:
Whereas, The Common Council adopted Resolution File 960170 on June 25, 1996, establishing a policy for the leasing of City facilities for the provision of wireless telecommunications services; and

Whereas, Said resolution also designated the Department of Administration Information Resource Manager as its sole negotiating agent for marketing City-owned sites to communication services vendors; and

Whereas, Personal communication services (PCS) companies from time to time have expressed interest in leasing City-owned sites; and

Whereas, In order to determine the viability and feasibility of any City property as an antenna site, certain short-term radio propagation tests must be performed by the interested companies; and

Whereas, To allow interested companies on City-owned sites to perform such tests, Entry and Testing Agreements must be signed by the City; and

Whereas, These Entry and Testing Agreements do not commit either side to leasing the affected City properties, and subsequent lease agreements must be reviewed and approved by the Common Council; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Common Council authorizes the proper City officials to enter into such Entry and Testing Agreements as may be needed on behalf of the City with interested PCS companies.
