Analysis
This resolution authorizes the proper City officers to execute a Quit Claim Deed of Facilities (QCD-1680 A and B) and Easement Amendment document conveying the combined sewer located in vacated East Highland Avenue between North Milwaukee Street and North Broadway, to Milwaukee School of Engineering in the 4th Aldermanic District. The sewer is being conveyed because it is no longer needed for public use.

Body
Whereas, In 1875, the City of Milwaukee constructed a 12-inch and 15-inch diameter combined sewer in East Highland Avenue, from North Milwaukee Street to North Broadway; and

Whereas, East Highland Avenue was vacated by the City of Milwaukee in 1965 (Council Resolution File No. 64-1821 and is now owned by Milwaukee School of Engineerin (MSOE); and

Whereas, Said sewer no longer serves the public interest; and

Whereas, MSOE has agreed to accept ownership of said sewer; and

Whereas, the City has water facilities in the same area as the sewer facilities and the City has easement rights regarding these water facilities per Wis. Stat. 66.1005(2) and per two 1965 easements (which easement rights the City will retain); and

Whereas, the City will amend its easement rights to show they are for water facilities and not for sewer facilities; now, therefore, be it
