Analysis
This ordinance prohibits the operation of dockless bicycle share systems in the city upon the public right-of-way. In addition, this ordinance allows dockless bicycle share operators to participate in a dockless bicycle share pilot study which will be administered by the department of public works.

Body
Whereas, Dockless bicycles do not require docking stations to park bicycles and instead can be parked and locked via internal wheel-lock, integrated locking devices such as u-locks or cables, or other mechanisms that prevent the wheels from moving and render the bicycles immobile; and

Whereas, Dockless bicycles may be a beneficial addition to the city’s transportation network; and

Whereas, Dockless bicycle share systems may allow rapid expansion of bicycle share opportunities into areas currently underserved by bicycle share; and

Whereas, Dockless bicycle technology is developing rapidly; and

Whereas, The city recognizes that dockless bicycle share has the potential for causing disruption and hazards in the public right-of-way; and

Whereas, It is the intent of the common council to prohibit dockless bicycle share systems in the city unless a pilot study can demonstrate their usefulness, effectiveness and safe operation; now, therefore

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 81-43.7 of the code is created to read:

81-43.7 Dockless Bicycle Redemption Fee. The fee for redemption of a dockless bicycle that has been impounded shall be $100. (See s. 101-53)

Part 2. Section 101-53 of the code is created to read:

101-53. Dockless Bicycle Share Systems.

1. DEFINITIONS. In this section:

a. “Bicycle” means any vehicle propelled by the feet acting upon pedals and having 2 or more wheels,...
