Title
Substitute resolution authorizing the sale of the surplus, City-owned lot at 2816 West State Street to Jonathan and Elizabeth Park, the owners of the adjoining property (4th Aldermanic District).
Analysis
This resolution will result in the sale of a vacant, tax-deed lot for use as green space.
Body
Whereas, On September 24, 2002, the Common Council adopted File Number 020650, a resolution which declared approximately 400 vacant, City-owned lots surplus to City needs and authorized the Department of City Development (DCD) to market these lots for new residential construction; and
 
Whereas, The property at 2816 West State Street was included in the list of vacant lots affected by File Number 020650; and
 
Whereas, Efforts to market this lot for new residential construction have thus far been unsuccessful; and
 
Whereas, Jonathan and Elizabeth Park, owners of the property at 2810-2812 West State Street, have offered $1,500 to purchase the lot in question for use as green space; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that Common Council File Number 020650 is amended such that the first "Further Resolved" clause in the resolution (which authorizes DCD to market the subject properties for new home construction) shall not apply to the lot located at 2816 West State Street; and, be it
 
Further Resolved, That the offer of Jonathan and Elizabeth Park to purchase this lot is accepted, that the Commissioner of City Development or assigns is authorized and directed to perform such acts as necessary to carry out the intent of this resolution and that the proceeds from the sale, less a 20 percent disposition cost reimbursement to the Redevelopment Authority of the City of Milwaukee, be credited to the Reserve For Tax Deficit Fund, Account No. 0001-334106.
