Analysis
This resolution authorizes payment of judgment in the lawsuit captioned Mwalimu Walker, et al. v. City of Milwaukee, et al., Case No. 2023-cv-5218, filed in Milwaukee County Circuit Court.
Body
Whereas, Plaintiff Mwalimu Walker filed a civil lawsuit against the City of Milwaukee and a named city employee in Milwaukee County Circuit Court Case No. 2023-cv-5218 arising from a motor vehicle accident involving a municipal vehicle; and

Whereas, the case was tried to jury on December 2nd and 3rd, 2025, resulting in a jury verdict for the Plaintiff; and

Whereas, the maximum recovery allowed under Wisconsin law for damages arising from a motor vehicle accident involving a municipal vehicle is $250,000; and

Whereas, state statutes authorize the imposition of litigation costs and interest in addition to and exclusive of damages and the statutory cap on damages; and

Whereas, the City of Milwaukee has a statutory obligation to indemnify City employees for judgments arising in the course and scope of their employment pursuant to Wis. Stat. § 895.46, and Plaintiff’s claims against the named city employee arose in the course and scope of his employment; and

Whereas, the City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay this claim; now, therefore, be it

Resolved, by the Common Council of the City of Milwaukee that proper City officers be and hereby are authorized and directed to issue the following City checks in the following amounts: to Gruber Law Offices Client Trust Account for $288,113.96 in full and final settlement of judgment, as soon as practicable; and so be it
