This resolution directs the Department of Administration - Intergovernmental Relations Division to seek introduction and passage of State legislation to remove the State statute which prohibits municipalities from enacting or enforcing ordinances regulating the use, disposition, or sale of auxiliary containers.
Body
Whereas, Section 66.0419(1)(a), Wis. Stats., defines auxiliary containers broadly enough to include plastic bags; and

Whereas, Section 66.0419(2) prohibits political subdivisions from regulating or banning auxiliary containers; and

Whereas, Plastic bags are among the most damaging types of pollutants to Milwaukee’s environment; and

Whereas, Plastic bags distributed from grocery and convenience stores are a major contributor to litter throughout Milwaukee; and

Whereas, Numerous cities across the country have banned plastic bags, imposed fees or taxes on these products, or implemented labeling, recycling and reuse programs; and

Whereas, Municipal legislation regulating the sale and distribution of environmentally-dangerous materials has been effective at limiting litter and pollutants; and

Whereas, The provisions of s. 66.0419(2), Wis. Stats., are unnecessarily restrictive in disallowing municipalities from enacting ordinances regulating the use, disposition, or sale of auxiliary containers; now, therefore be it
