Body
Whereas, The applicant has requested permission to install and maintain an awning that projects into the public way more than the 6 feet allowed by the Milwaukee Code of Ordinances; and
Whereas, Said awning may only legally encroach into the public right-of-way by granting of a special privilege resolution adopted by the Common Council; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that 2625 Downer LLC, c/o Brett Grasse, 255 South Water Street, Suite B, Milwaukee, WI 53204 is hereby granted the following special privilege:
To install and maintain a code non-compliant awning projecting 12 feet into the west, 23-foot wide sidewalk area of North Downer Avenue. Said awning commences at a point approximately 180 feet north of the northline of East Belleview Place and extends 29 feet to the north. Said awning projects into the public right-of-way more than the 6 feet allowed by Section 245-7-4 of the Milwaukee Code of Ordinances.
Said awning shall be used, kept and maintained to the satisfaction of the Commissioners of Public Works and Department of Neighborhood Services.
Said awning shall be maintained or removed from the public right-of-way, at such future time as they are no longer needed, to the satisfaction of the Commissioners of Public Works and Department of Neighborhood Services.
