Title

Resolution approving a modification to language in the active lease agreement between Port Milwaukee and the U.S. Navy for a parcel located at 2401 S. Lincoln Memorial Drive

Analysis

This resolution would authorize changes to language in the current lease agreement between Port Milwaukee and the U.S. Navy intended to clarify rights and responsibilities of both parties upon expiration or termination of the agreement.

Body

Whereas, the Milwaukee Common Council previously adopted file 181029 which approved a lease Agreement with the U.S. Navy for a parcel of 5.9 acres located at 2401 S. Lincoln Memorial Drive, and

Whereas, the original lease agreement, executed May 18, 1952, includes language pertaining to lease expiration and termination that could be interpreted in multiple ways, and

Whereas, the U.S. Navy requested modification to the agreement to clarify rights and responsibilities upon expiration or termination of the agreement, and

Whereas, The Board of Harbor Commissioners acted by unanimous vote to approve the language modification, now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that said Common Council hereby ratifies and approves the modification to language in the active lease agreement between Port Milwaukee and the U.S. Navy for a parcel located at 2401 S. Lincoln Memorial Drive, and, be it

Further Resolved, That the designated officers of said government and of said Board of Harbor Commissioners are hereby authorized and directed to execute an agreement to carry out this purpose as prepared by the City Attorney's Office.
