Title

Analysis
This substitute resolution will remove a deed restriction imposed by the City of Milwaukee that prohibits activities inconsistent with a Board of Harbor Commissioner's development plan dated June 5, 1951.
Body
Whereas, Pursuant to Common Council File No. 44631-a, adopted October 23, 1951, the City of Milwaukee conveyed to Pfister & Vogel Tanning Company by a Warranty Deed dated December 7, 1951, a vacant lot adjacent and north of vacated East Lyon Street that adjoined the company's property at 1531 North Water Street; and
Whereas, The deed of conveyance contained restrictions that the development of the land conveyed therein "will be generally developed in accordance with that certain plan dated June 5, 1951, and approved by the Board of Public Land Commissioners on September 12, 1951"; and
Whereas, USL Land, LLC, the purchaser of the former Pfister & Vogel Tanning Company property at 1531 North Water Street, has requested removal of this deed restriction; and
Whereas, The June 5, 1951 plan related to a dockwall improvement project that has since been completed and is no longer pertinent to the development of the Pfister & Vogel Tanning Company property; and
Whereas, The Common Council desires to facilitate the development of the former Pfister & Vogel Tanning Company property by removing said deed restriction; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute the necessary legal documents to remove restriction number 5 contained in the deed dated December 7, 1951 and identified as Document No. 3076478.
