Title

Resolution directing City departments to develop work rules for pothole-reporting by their employees.

Analysis

This resolution directs that the following departments develop policies and procedures for reporting potholes by their employees who work in the field: Department of Public Works, Milwaukee Water Works, Department of Neighborhood Services, Department of City Development, City Assessor’s Office, and the Health Department.

Body

Whereas, Milwaukee streets are riddled with potholes, causing aggravation to drivers and millions of dollars in damage to vehicles; and

Whereas, Many City employees drive on these roads while performing their daily assignments; and

Whereas, Department of Public Works road crews cannot repair potholes of which they are unaware; and

Whereas, Milwaukee is immune from liability for any damage that occurs to a person’s vehicle due to a defect in a sidewalk or street based on 2011 Wisconsin Act 132; and

Whereas, Immunity from liability does not relieve the City of its responsibility for repairing potholes; and

Whereas, City employees are to act in the best interest of the City; and

Whereas, City employees who work in the field must begin reporting known defects in our city’s roadways; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the following  City departments shall develop policies and procedures for reporting potholes by their employees: Department of Public Works, Milwaukee Water Works, Department of Neighborhood Services, Department of City Development, City Assessor’s Office, and the Health Department; and, be it

Further Resolved, That department heads shall report their new policies to the Common Council no later than July 1, 2017.
