This substitute resolution will provide the legislative approvals for two additional connections to the Grand Avenue Parking Garage. One connection will be along the Garage's western elevation, which will connect the proposed Courtyard by Marriott Hotel elevator to the Garage. The other connection will be along the north elevation of the Garage and will connect the proposed YMCA facility on the fourth floor of the John Plankinton Building to the Garage.
BODY:
Whereas, The City of Milwaukee ("City") is the owner of two parking structures adjacent to and connected to the Grand Avenue Shopping Center; and

Whereas, On July 1, 1982, the City and the Redevelopment Authority of the City of Milwaukee entered into an agreement known as the Restated Prime Parking Garage Lease ("Prime Agreement"), which authorized the Redevelopment Operating Entity Corporation ("ROEC"), which is also a party to said Prime Agreement, to lease the structures to an Operator (Rouse-Milwaukee Garage Maintenance, Inc.) under the terms and conditions set forth in the Prime Agreement; and

Whereas, On July 1, 1982, ROEC and the Operator entered into an agreement known as the Restated Parking Garage Lease and Management Agreement ("Agreement") pursuant to which the Operator subleased and agreed to manage the Grand Avenue Parking Garage ("Garage"); and

Whereas, Pursuant to Section 3.2 of the Agreement, the City must give its consent prior to any substantial structural alterations to the Garage, without limitations, including the construction of any skywalk or walkway which would have its point of ingress and/or egress connected to the Garage; and
