This resolution authorizes the City Attorney to intervene on behalf of the City in Public Service Commission of Wisconsin (PSC or Commission) Docket No. 6630-CU-101, relating to Wisconsin Electric Power Company's (WEPCO) application to convert its Valley Power Plant from a coal-fired cogeneration facility to a natural gas-fired cogeneration facility.

Whereas, During the Council's August recess, WEPCO's application advanced to a stage where any interested party wishing to preserve its rights was required to intervene in the proceeding; and
Whereas, The City Attorney at the request of the Mayor's office, intervened in the matter so as to preserve the City's rights; and
Whereas, The City may be significantly impacted by the Commission's action or inaction in this proceeding, particularly relating to the issue of the allocation of project capital costs among WEPCO's electric customers and downtown steam customers; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City Attorney's office is authorized to intervene in PSC docket number 6630-CU-101 on the City's behalf and to protect the City's interests in that proceeding.
