Analysis

This resolution amends the contract with Wisconsin Gas Water Services to allow water service to the Village of Thiensville.

Body

Whereas, In November 1998 the City entered into a contract for the sale of water at wholesale to Wisconsin Gas Water Services for resale in the City of Mequon; and,

Whereas, Wisconsin Gas Water Services has recently requested permission to include the Village of Thiensville (which lies wholly within the boundaries of the City of Mequon) in its service area; and

Whereas, The contract provides for a readjustment of the service area and the Milwaukee Water Works has no objection to including the Village of Thiensville in the area served by Wisconsin Gas Water Services; and

Whereas, Article III (a) of the contract limits Milwaukee's obligation to provide water to a "Maximum Daily Flow Rate of 1,500 gallons per minute", which is ambiguous; now therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the contract between the City and Wisconsin Gas Water Services is hereby amended to include the Village of Thiensville within the permitted service area, and be it

Further Resolved, That Article III (a) be amended to read "To provide Adequate Water Service to WGC at a Delivery Point designated by WGC at a Maximum

Flow Rate of 1,500 gallons per minute".
