Analysis
This ordinance prohibits the issuance of a new alcohol beverage license for any premises located in a census tract in which 40.0% or more of residents are living below the federal poverty level, as indicated by the most recent U.S. census bureau American community survey 5-year estimate or the latest federal decennial census, whichever is more recent.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 90-14-3 of the code is created to read:
90-14. Restrictions as to Location of Premises.
3. PROHIBITION IN HIGH-POVERTY CENSUS TRACTS. No alcohol beverage license shall be issued for any premises located in a census tract in which 40.0% or more of residents are living below the federal poverty level, as indicated by the most recent U.S. census bureau American community survey 5-year estimate or the latest federal decennial census, whichever is more recent. This prohibition shall not apply to the issuance of a renewal license.
