Whereas, The above-captioned case concerns a personal injury action; Milwaukee County Case No. 02-CV-010254, seeking compensation for injuries sustained by plaintiff Suzanne M. Fortier in two separate automobile collisions one which occurred on January 21, 2001 and one which occurred on July 25, 1998; and
Whereas, The City has a subrogation claim of $4,772.38 for medical payments made pursuant to its Basic Health Plan on behalf of Suzanne M. Fortier for treatment of injuries sustained in connection with the accidents; and
Whereas, Plaintiff has offered the City the amount of $1,000.00 in settlement of its subrogation claim; and
Whereas,The amount offered is a fair and reasonable settlement of the City's subrogation claim; now, therefore be it
Resolved, By the Common Council of the City of Milwaukee that an authorized representative of Wisconsin Physicians Service Insurance Corporation, the claims administrator for the Basic Health Plan, be and hereby is authorized and directed, on behalf of the City, to accept & settlement of not less than $1,000.00 in release and satisfaction of the City's subrogation claim against Suzanne M. Fortier, and to execute and deliver any necessary releases on behalf of the City.
