This resolution expresses the City of Milwaukee's opposition to Assembly Bill 409 which is currently pending in the Wisconsin Legislature. Under current state law, subject to certain exceptions, an employer may not discriminate against an individual in employment based on conviction record, though the law permits such employer to refuse to employ, or to bar or terminate from employment, an individual who has been convicted of an offense the circumstances of which substantially relate to the circumstances of a particular job. Assembly Bill 409 eliminates conviction record as a prohibited basis of employment discrimination for employers and employment agencies.
BODY:
Whereas, Under current state law, subject to certain exceptions, an employer may not discriminate against an individual in employment based on conviction record; and

Whereas, Current state law permits an employer to refuse to employ, or to bar or terminate from employment, an individual who has been convicted of an offense the circumstances of which substantially relate to the circumstances of a particular job; and

Whereas, There is a bill in the Wisconsin Legislature, 1997 Assembly Bill 409, which would eliminate conviction record as a prohibited basis of employment discrimination for employers and employment agencies; and

Whereas, Assembly Bill 409 should not be supported because it allows employers to freely discriminate against anyone who may have been convicted of even a minor crime, regardless of when the crime occurred; and

Whereas, If enacted, this policy will most likely have disparate impact against minorities who make up a disproportionate number of the jail and prison populations; now, therefore, be it
