Analysis
This resolution authorizes the Commissioner of Public Works to execute an amendment to the contract with Resource Recovery Systems, LLC, for the processing and marketing of recyclables. The amended economic terms reflect the significant changes in the economic conditions of operating a Materials Recovery Facility.

Body
Whereas, In April 2014 the Common Council of the City of Milwaukee adopted Council file 131796 authorizing the Commissioner of Public Works to execute a contract with Resource Recovery Systems, LLC, for the construction and operation of a Materials Recovery Facility (MRF) in partnership with Waukesha County; and

Whereas, In October 2017, Resource Recovery Systems, LLC, was acquired by Republic Services, Inc.; and

Whereas, The economic conditions of operating a MRF have significantly changed involving higher costs and depressed market prices which made the renegotiation of the operating agreement with Republic Services, Inc. appropriate; and

Whereas, Terms have been agreed to for an amendment to the City of Milwaukee and Waukesha County operating agreements with Republic Services, Inc. after nine months of joint negotiations among the parties, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Common Council authorizes the Commissioner of Public Works to execute a contract amendment with Resource Recovery Systems, LLC, in substantially the same form as is attached to this file; and be it

Further Resolved, That execution of the City’s contract amendment, is conditional upon the Waukesha County Board of Supervisors’ approval of Waukesha County’s amendment with Resource Recovery Systems, LLC, in substantially the same form as is attached...
