Title

Substitute resolution relative to an Intergovernmental Cooperation Agreement between the City of Milwaukee Health Department and Milwaukee Public Schools regarding student health records.

 

Analysis

This substitute resolution authorizes the City of Milwaukee Health Department to access Milwaukee Public Schools’ student records for the purposes of confirming and addressing immunization needs for students, investigating infectious disease outbreaks, and carrying out lead hazard investigations as required by State law.

 

Body

Whereas, Milwaukee Public Schools (MPS) maintains educational and physical health records, including immunization records as defined within Wis. Stat. Chapter 118.125, which are subject to the Family Educational Rights and Privacy Act (FERPA) and the Wisconsin Pupil Records Law; and

 

Whereas, The Milwaukee Health Department (MHD) will benefit from access to MPS’ records regarding pupil immunization and enrollment to perform statutorily mandated functions of disease control and environmental hazard investigations; and

 

Whereas, The Health Department and MPS desire to increase collaboration around critical public health needs and improve health outcomes and service to MPS students and families; and

 

Whereas, the Agreement attached to this resolution outlines MHD’s responsibility to maintain MPS’s pupil immunization records and other physical health records confidential from unauthorized personnel, as required by federal and state laws and regulations; now, therefore be it

 

Resolved, that the Health Commissioner is hereby authorized to execute an Intergovernmental Cooperation Agreement substantially similar to the agreement attached to this file as

Exhibit A.
