Body
Whereas, The City of Milwaukee acquired 3447 North 6th Street in a tax foreclosure action on February 22, 1999 and subsequently sold it to Spring Life Home Care on March 1, 2000; and
Whereas, As a condition of sale, the buyer was required to bring the property into compliance with the building code within the time period specified by the Department of Neighborhood Services; and
Whereas, The buyer has failed to comply with the repair requirements of the sale and the property is presently vacant, boarded and a blight on the community; and
Whereas, The deed of conveyance contains a reversionary clause in favor of the City in the event the buyer failed to satisfy code requirements, and accordingly the Department of City Development recommends that the City commence legal action to enforce the reversionary covenant; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the City Attorney is authorized and directed to immediately commence appropriate legal action necessary to recover title to the former improved tax-deed property at 3447 North 6th Street due to the buyer's failure to perform under the terms and conditions of the sale.
