Analysis
This resolution authorizes settlement of EEOC Charge No. 260-2004-00710, ERD Case No. CR200304864, Eric J. Moore v. City of Milwaukee, Milwaukee Police Department, and/or Fire and Police Commission and all related claims in the amount of $20,000.00 which represents reimbursement for attorney's fees and costs, compensatory damages and any other claim for damages that could be brought concerning the subject matter of the charge.

Whereas, The charging party, Eric J. Moore, filed a discrimination charge with the Equal Rights Division of the State of Wisconsin, Department of Workforce Development (ERD), and the Equal Employment Opportunity Commission (EEOC), claiming discrimination based upon his race and upon his association with persons of another race in November, 2003, alleging among other things, his asserted failure to be promoted to Captain of Police at an earlier date; and
Whereas, The parties have agreed to settle this lawsuit in the amount of $20,000.00 which represents reimbursement for attorneys fees and costs, and compensatory damages and includes any other claims for damages of any nature that could have been brought, as set forth in the proposed Settlement Agreement and Release attached to the file; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it is expeditious and just to settle this lawsuit; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the City Attorney be and hereby is authorized to execute the Settlement Agreement attched to the file; and, be it
Further Resolved, That the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $20,000.0...
