This resolution authorizes the Commissioner of Public Works to waive the charge due for connection to the existing combined sewer and water main located in North Commerce Street for the property at 401 East Reservoir Avenue.


BODY:
Whereas, The Redevelopment Authority facilitated the sale of the land owned by the Milwaukee Metropolitan Sewerage District (MMSD) to Cornerstone Property Development LLC; and

Whereas, The land which represents a former railroad right-of-way, was originally programmed as green space in the Beer Line "B" planning study due to the steep slope and amount of fill material present on the site; and

Whereas, The developer acquired adjacent property along East Reservoir Avenue and when combined with the MMSD property was able to propose a development that would add $6 million to the City's tax base; and

Whereas, The charge due for connection was not known at the time the sale of the property was facilitated; and

Whereas, When the developer applied for a foundation permit for the development, it was discovered that the out-of-grade railroad property had never been assessed for sewer or water connections thus resulting in a charge due for these facilities; and

Whereas, The charge due can only be waived by the Common Council; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized and directed to waive the charge due for connection to the combined sewer and water main located in North Commerce Street for the property at 401 East Reservoir Avenue.
