Title
Resolution releasing a No Vehicular Access Restriction from the South limits of South 26th Street to Parcel 2, approximately 172 feet south of West Whitaker Avenue, in the 13th Aldermanic District.
Analysis
This resolution will release from certain property an unnecessary No Vehicular Access Restriction.
Body
Whereas, Certified Survey Map Number 4465, recorded on June 5, 1984, placed a No Vehicular Access Restriction to the South limits of South 26th Street to Parcel 2 in the Certified Survey Map; and
Whereas, Access to Parcel 2 within Certified Survey Map Number 4465, is from South 26th Street; and
Whereas, A future owner of 4450 South 26th Street is planning on building an apartment development, however the existing access from South 26th Street would not allow for construction equipment, therefore they are requesting the removal of this No Vehicular Access Restriction to allow development and improvement of the land; and
Whereas, Upon reviewing the No Vehicular Access Restriction, the City Engineer has no objection to releasing of said access restriction; now, therefore, be it
Resolved, by the Common Council of the City of Milwaukee, that the restriction for No Vehicular Access to from the South limits of South 26th Street to Parcel 2, approximately 172 feet south of West Whitaker Avenue, in the Southwest 1/4 of Section 19, Township 6 North, Range 22 East, be released; and, be it
Further Resolved, That the City Comptroller or City Engineer is hereby directed to have a certified copy of this resolution recorded in the office of the Register of Deeds of Milwaukee County.
