Analysis
This resolution approves an intergovernmental agreement between the City of Milwaukee and the City of Franklin relating to the sale of water for considerations that are separate and distinct from those under the authority of the Public Service Commission of Wisconsin. The agreement, among other provisions, provides for a Regional Benefits Payment totaling $2.0 million from the City of Franklin to the City of Milwaukee’s general fund.

Body
Whereas, The Common Council of the City Milwaukee, in Resolution File No. 171517, directed the City of Milwaukee negotiating team to commence negotiations with the City of Franklin regarding a possible water service agreement and intergovernmental agreement relating to the sale of water to the City of Franklin; and

Whereas, The Public Service Commission of Wisconsin has recognized that pursuant to state law, municipalities are authorized to enter into intergovernmental agreements for provisions separate from those to be included in a water service agreement, provided that such intergovernmental agreements do not conflict with the Commission’s regulatory authority; and

Whereas, The negotiating team has negotiated an intergovernmental cooperation agreement between the City of Milwaukee and the City of Franklin relating to the sale of water for considerations separate and distinct from those under the authority of the Public Service Commission of Wisconsin, a copy of which is included as an attachment to this file; and
