Body
Whereas, The Milwaukee Public School ("MPS") has requested that a property at 6914 West Appleton Avenue, Milwaukee, WI which has been leased for approximately five (5) years by MPS be considered for purchase under a land contract, providing that such land contract does not violate the state constitutional prohibition on debt; and
Whereas, The Office of City Attorney has issued an opinion dated May 3, 2001 which indicates that with certain assurances in the land contract, relative to an annual appropriations provision and a provision which makes clear that the contract is not considered City debt, a land contract is allowable and is not in violation of the Wisconsin Constitution; and
Whereas, The owner of the property at 6914 West Appleton Avenue has indicated a willingness to enter into a land contract with MPS and on terms agreeable to MPS; and
Whereas, Under sec. 119.16(3)(b), Stats., the City of Milwaukee holds title to school sites in trust for the Milwaukee Board of School Directors; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the conveyance of title to the City of Milwaukee in trust for the Milwaukee Board of School Directors for the property at 6914 West Appleton Avenue, Milwaukee, WI is hereby approved, and the proper City officials are hereby authorized and directed to execute any necessary documents to accept such conveyance.
